  13. DISCLAIMER OF WARRANTY.  
  14. Freeware Software is provided on an "AS IS" 
  15. basis, without warranty of any kind, including 
  16. without limitation the warranties that the 
  17. Software is free of defects, merchantable, fit 
  18. for a particular purpose or non-infringing. 
  19. The entire risk as to the quality and performance 
  20. of the Software is borne by you. Should the 
  21. Software prove defective in any respect, you and 
  22. not Licensor or its suppliers assume the entire 
  23. cost of any service and repair. In addition, the 
  24. security mechanisms implemented by the Software 
  25. have inherent limitations, and you must determine 
  26. that the Software sufficiently meets your requirements.

  29. LIMITATION OF LIABILITY. UNDER 
  30. NO CIRCUMSTANCES AND UNDER NO 
  31. LEGAL THEORY, TORT, CONTRACT, 
  32. OR OTHERWISE, SHALL LICENSOR OR 
  33. ITS SUPPLIERS OR RESELLERS BE 
  34. LIABLE TO YOU OR ANY OTHER PERSON 
  35. FOR ANY INDIRECT, SPECIAL, 
  36. INCIDENTAL, OR CONSEQUENTIAL 
  37. DAMAGES OF ANY CHARACTER INCLUDING, 
  38. WITHOUT LIMITATION, DAMAGES FOR 
  39. LOSS OF GOODWILL, WORK STOPPAGE, 
  40. COMPUTER FAILURE OR MALFUNCTION, 
  41. OR ANY AND ALL OTHER COMMERCIAL DAMAGES 
  42. OR LOSSES. IN NO EVENT WILL 
  43. LICENSOR BE LIABLE FOR ANY DAMAGES 
  44. IN EXCESS OF THE AMOUNT LICENSOR 
  45. RECEIVED FROM YOU FOR A LICENSE 
  46. TO THE SOFTWARE, EVEN IF LICENSOR 
  47. SHALL HAVE BEEN INFORMED OF THE 
  48. POSSIBILITY OF SUCH DAMAGES, OR 
  49. FOR ANY CLAIM BY ANY THIRD PARTY. 
  50. THIS LIMITATION OF LIABILITY SHALL 
  51. NOT APPLY TO LIABILITY FOR DEATH 
  52. OR PERSONAL INJURY RESULTING FROM 
  53. LICENSOR'S NEGLIGENCE TO THE EXTENT 
  54. APPLICABLE LAW PROHIBITS SUCH 
  55. LIMITATION. SOME JURISDICTIONS 
  56. DO NOT ALLOW THE EXCLUSION OR 
  57. LIMITATION OF INCIDENTAL OR 
  58. CONSEQUENTIAL DAMAGES, SO THIS 
  59. EXCLUSION AND LIMITATION MAY NOT

  63. HIGH RISK ACTIVITIES.  The Software is not fault-
  64. tolerant and is not designed, manufactured or intended 
  65. for use or resale as on-line control equipment in 
  66. hazardous environments requiring fail-safe 
  67. performance, such as in the operation of
  68. nuclear facilities, aircraft navigation or 
  69. communication systems, air traffic control, direct 
  70. life support machines, or weapons systems, in which 
  71. the failure of the Software could lead directly to 
  72. death, personal injury, or severe physical or 
  73. environmental damage ("High Risk Activities").
  74. Accordingly, Licensor and its suppliers specifically 
  75. disclaim any express or implied warranty of fitness 
  76. for High Risk Activities.

  79. TITLE. The Software is protected by copyright and 
  80. other intellectual property laws. Title and related 
  81. rights in the content accessed through the Software 
  82. is the property of the applicable content owner and 
  83. is protected by applicable law.

  86. U.S. GOVERNMENT END USERS.  The Software is a 
  87. "commercial item," as that term is defined in 48 
  88. C.F.R. 2.101 (Oct. 1995), consisting of "commercial 
  89. computer software" and "commercial computer 
  90. software documentation," as such terms are used in 
  91. 48 C.F.R. 12.212 (Sept. 1995). Consistent 
  92. with 48 C.F.R. 12.212 and 48 C.F.R. 227.7202-1 through 
  93. 227.7202-4 (June 1995), all U.S.  Government End Users 
  94. acquire the Software with only those rights set forth 
  95. herein.
